Patents

US patents, the most sought-after commodity in the world of patents, enable their owners to stake a claim in the richest market on the globe. US patents that are acquired to support a corporation’s present and future market activity represent an asset whose value far exceeds the investment in the property that it protects. Whether high quality IP rights are to be used offensively or defensively, the value of IP in any field cannot be overestimated.

‘US patent pending’ is a statement that shows serious intent. Just having a patent application in the US can help mature corporations, startups or even lone entrepreneurs who are just starting out attract capital and partners, deter competitors, and increase the chances of commercial success.

The JMB Davis Ben-David US patent prosecution team includes experienced and exceptionally knowledgeable patent attorneys and agents who are committed to representing our clients in keeping with our rigorous standards. In addition to helping our Israeli clients obtain US patents in a variety of fields, we also assist our overseas associates from the US to Europe, and from the Far East to Australia, to skillfully and efficiently file and prosecute patents in the US within affordable budgets.

Because our main offices are in Israel, our workdays overlap with our clients’ in both Europe and the Far East; and since Israel’s work week begins on Sunday, we are hard at work on behalf of our clients when most of the world is still enjoying the weekend.

Israel enjoys a well-earned reputation as a hothouse for enterprises built on research and development in diverse fields of advanced science and technology. It is home to the world’s largest number of startup companies outside of the US as well as to multinational companies such as IBM, Cisco, Intel and Google. A large number of Israeli companies and research establishments participate in cooperative ventures with corporations from Japan, India, the US, Germany and the United Kingdom, among others, in fields as diverse as biotechnology, pharmaceuticals, medical devices, telecommunications, computer science, defense technologies, solar energy, and water technologies.

The JMB Davis Ben-David Israel filing and prosecution team represents clients from dozens of countries overseas in leading fields of endeavor, working with their legal representatives to obtain patents in Israel. Where appropriate and approved by the client, we apply innovative ‘tools’ provided by the Israeli legislature and the Patent Office to advance patent prosecution. These tools include accelerated examination, section 17(c) ‘modified’ examination, and the Patent Prosecution Highway.

When possible, we assist clients who have missed filing deadlines despite taking due care to claim Convention Priority or benefit from an international filing.

Since Israel implemented the provisions of the Patent Cooperation Treaty in 1995, PCT use has become an integral part of our work, both for Israeli clients seeking protection in other jurisdictions and for overseas companies seeking to acquire patent rights in Israel. Israeli applicants account for proportionally more PCT applications than most other countries and Israel is one of the most popular destinations for national phase filings.

In 2012 Israel’s Patent Office joined the elite group of patent offices recognized by the World Intellectual Property Organization as a Search and Examination Authority. It is already issuing high quality search and examination reports that meet the standards set by the top patent offices worldwide and issues them more quickly than the USPTO and EPO.

Our practice includes filing PCT applications both at the USPTO and at the International Bureau in Geneva, providing all options to our varied community of clients from around the world.

Because Sunday is a regular work day for us and for the Israel Patent Office, we provide a crucial time advantage by filing all patent applications including PCT while other patent offices are closed.

The ‘rest of the world’ includes dozens of jurisdictions where our clients have obtained significant numbers of patents over the past couple of decades. We have established working relationships with a vast network of intellectual property firms worldwide, whose expertise our clients rely on to obtain patent rights in their respective jurisdictions.

Many of our clients have significant international business interests extending across scores of countries. These clients benefit from our broad experience in managing their portfolios, conducting coordinated prosecution in the different countries of interest, and dealing with local requirements as they arise.
